Terms of Use — lawyer-review draft
Last updated: 13 September 2026
Draft only. This is not legal clearance. Replace bracketed fields after the final name, domain, public contact details, and legal review are in place.
1. Who these terms are with
These terms are between you and [developer legal name], trading as Quitmark, at [public trader address], Denmark. Contact: [support email]. Apple and Google are not parties to these terms except where their mandatory platform terms apply.
2. Adult use and acceptance
Quitmark is intended only for people aged 18 or older. By downloading or using it, you agree to these terms and the applicable store rules. Do not use it where doing so would be unlawful.
3. Personal tracking, not safety or medical advice
Quitmark lets you privately record an activity you choose to stop or do less often. You provide the activity name, plan endpoints, amounts, dates, spacing preference, and optional goals. For eligible occurrence-based reduction plans, the app calculates daily steps and rolling planned times from those inputs.
Quitmark does not determine whether stopping or reducing an activity is safe or appropriate. It does not diagnose, prevent, monitor, predict, prognose, treat, or alleviate a disease, injury, disability, or physiological or pathological state. It does not provide medical advice, prescriptions, symptom interpretation, or personal health measurements.
Do not use Quitmark to manage medication, alcohol or drug withdrawal, eating-disorder treatment, self-harm, or another medical condition. Seek appropriate professional help for medical or safety decisions, and contact local emergency services for urgent help.
4. Your data and backups
Activity names, plans, records, Moments, notes, goals, and settings are stored on your device. There is no Quitmark account or developer-operated cloud sync. You are responsible for exports and device access. Deleting the app, losing a device, or clearing storage may permanently remove local data. Deleting local data does not remove an iOS device backup or files you previously exported or shared.
An export or share sends a file only to the destination you choose. The Privacy Policy explains platform-store processing and support links separately.
5. Quitmark Plus
The optional Quitmark Plus product is a one-time, non-consumable purchase for the app’s paid features on the purchasing platform. The store shows the actual localized price before confirmation. Payment, family sharing if available, refunds, chargebacks, and restoration are handled under Apple’s or Google’s rules. “Lifetime” means while the app and compatible store service remain available; it does not promise that any software service will exist indefinitely.
6. Acceptable use
You may use the app for personal, lawful purposes. You may not interfere with its operation, distribute modified copies, evade store payment controls, use it to harm others, or infringe intellectual-property rights. Mandatory rights to reverse engineer for interoperability are not restricted.
7. Availability and changes
The app is provided on an “as available” basis. Device, operating-system, and store changes may affect it. Features, copy, and compatibility may change for safety, accuracy, or maintenance. Material term changes will be communicated through the app or store listing when practicable.
8. Liability and consumer rights
Nothing in these terms excludes liability that cannot lawfully be excluded, including mandatory consumer rights. Subject to those rights, the developer is not responsible for decisions made in place of appropriate professional advice, or for indirect losses not reasonably foreseeable from ordinary personal use.
9. Termination
You may stop using and delete the app at any time. The developer may restrict use required by law or in response to material misuse. Clauses intended to survive termination, including intellectual property and liability limits, continue to apply.
10. Danish law and disputes
These terms are governed by Danish law, without removing mandatory consumer protections of the country where you live. Courts with jurisdiction under applicable consumer law may hear disputes. Counsel must confirm this wording and whether an approved consumer-dispute body/ODR notice is required.
